Terms of Service

These Terms form a binding agreement between you and Hooeychat. If you do not agree, do not use Hooeychat. Please also read our Privacy Policy and Community Guidelines, which explain how we handle your information and what conduct we expect on the platform.

By using the Service, you signify your agreement to these Terms. We may update the Terms from time to time. Please review this page periodically. Your continued use of Hooeychat after changes are posted constitutes acceptance of the revised Terms.

You must be at least 18 years old to use Hooeychat. No person under 18 is permitted to use the Service. By using Hooeychat, you represent and warrant that you meet this requirement, that the information you provide is accurate, and that you have the legal capacity to enter into these Terms. We may suspend or terminate accounts that appear to belong to minors or that provide false age information.

Hooeychat provides browser-based random video chat, matching, profiles, friends, messaging, rematch, and optional paid premium features. Video connections may use peer-to-peer technology where supported. Stranger-call text chat is ephemeral and intended to disappear when a call ends.

We may change, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee uninterrupted access, error-free operation, or that you will always be matched with another user.

Hooeychat involves live, real-time interaction with other users. Content you encounter — including video, audio, text, images, and profile information — may not be reviewed, edited, or controlled by us before you see it. We may monitor reports and take enforcement action, but we are not obligated to review all activity and are not responsible for delays or failures in removing content or restricting users.

You may be exposed to material or behavior you find offensive, inappropriate, or harmful. You assume the risk and sole responsibility for your exposure to other users and for your interactions on and off the platform. You use Hooeychat at your own risk.

You are responsible for:

• Providing accurate registration information, including your birthdate
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring that anyone using Hooeychat through your device or connection is aware of these Terms and complies with them
• Notifying us promptly if you believe your account has been compromised

We may refuse registration, reclaim usernames, or suspend accounts that violate these Terms or create risk for other users or Hooeychat.

You agree to follow our Community Guidelines, which are incorporated into these Terms. In summary, you agree not to use Hooeychat to:

• Violate any applicable law or regulation
• Harass, threaten, abuse, stalk, defame, dox, or harm another person
• Share sexually exploitative content, non-consensual imagery, or content involving minors in any form
• Display pornographic, obscene, or sexually provocative content on camera or in chat, or promote illegal activity
• Point your camera at screens, photos, text, or use emulators, filters, or avatars that hide your live appearance
• Impersonate another person or misrepresent your identity, age, or affiliation
• Spam, send promotional links, solicit money, advertise, or use the Service for unauthorized commercial purposes
• Record, screenshot, redistribute, or publish another user's video, audio, or messages without consent where required by law
• Harvest or collect information about users for unsolicited contact, spam, or profiling
• Knowingly solicit or collect personal information from anyone under 18
• Attempt to bypass safety tools, access other users' accounts, or interfere with the Service
• Upload malware or use bots, scrapers, scripts, plugins, or other automated means without our written permission

You are responsible for all content transmitted from your device and account, including use by anyone you allow on your device. An unintentional or brief violation may still result in enforcement action.

We may investigate reports, restrict access, block users, preserve records, and cooperate with law enforcement where appropriate. You can report or block other users through in-product safety tools. We do not endorse user conduct or content.

You retain ownership of content you submit, but you grant Hooeychat a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, and process that content solely as needed to operate, secure, and improve the Service, enforce these Terms, respond to reports, and comply with law.

You represent and warrant that:

• You have the right to submit your content and grant the license above
• Your content and use of Hooeychat do not violate these Terms or applicable law
• Your content does not infringe the rights of any third party
• All information you provide to us is accurate and complete

You are solely responsible for your content and interactions. We are not responsible for what users say, show, or do on or off the platform.

The Service may rely on or link to third-party websites, services, or content (including payment processors, GIF providers, and link-preview sources). We do not control third-party services and are not responsible for their content, policies, security, or practices.

If you access a third-party service through Hooeychat, you do so at your own risk and should review that service's terms and privacy policy. Inclusion of a link or integration does not imply our endorsement.

To report content or behavior that violates these Terms, use the in-app report tools where available. For escalations, submit a request in Settings → Help & support or email support@hooeychat.com with the subject line Complaint. Please include:

• Your name, email address, and username (if you have one)
• A clear description of the issue and why it violates these Terms
• The username or profile involved, if known
• Whether the issue occurred during a stranger call, friend chat, or on a profile
• Any relevant details that will help us investigate

We will review complaints in our discretion and may take action including warnings, restrictions, or account termination. Users who receive multiple substantiated complaints in a short period may be automatically restricted or banned. By using Hooeychat, you agree to this reporting and enforcement process.

We are not obligated to provide status updates or outcomes. Knowingly false reports may result in action against your account. If another user behaves offensively toward you, report them — do not respond with the same misconduct.

Hooeychat offers optional paid plans. Prices, features, and billing intervals are shown at checkout or on the site. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.

Subscriptions renew automatically unless canceled before the renewal date through the billing tools we provide or the Stripe customer portal, where available. Except where required by law, fees are non-refundable once a billing period has begun. We may change pricing or plan features with reasonable notice where required.

You may stop using Hooeychat at any time. We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, created risk or legal exposure, or if we discontinue the Service. Upon termination, provisions that by their nature should survive will remain in effect.

HOOEYCHAT IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

We do not warrant that the Service will be secure, uninterrupted, error-free, or free of viruses or harmful components. You are responsible for configuring your devices and using appropriate security protections. We do not guarantee the conduct, identity, age, location, or intentions of any user.

If you are dissatisfied with the Service, your sole remedy is to stop using Hooeychat, subject to applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOEYCHAT AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless Hooeychat and its service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, your interactions with other users, or your violation of these Terms or applicable law.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense.

Before filing a claim, contact us through Help & support or at support@hooeychat.com and attempt to resolve the dispute informally.

Except for claims seeking injunctive relief related to misuse of the Service, intellectual property, or confidential information, any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved through binding arbitration on an individual basis under the rules of the American Arbitration Association, before a single arbitrator, with the seat in Florida unless the parties agree otherwise. Judgment on the award may be entered in any court having jurisdiction.

You and Hooeychat each waive any right to participate in a class action, class arbitration, or other representative proceeding to the extent permitted by law. JURY TRIAL WAIVER: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND HOOEYCHAT WAIVE ANY RIGHT TO A TRIAL BY JURY.

Governing law. These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws provide otherwise.

Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including outages, natural disasters, labor disputes, government actions, or failures of third-party providers.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.

Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines constitute the entire agreement between you and Hooeychat regarding the Service.

Severability. If any provision is held invalid, the remaining provisions remain in effect.

Waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.

Electronic communications. You consent to receive communications electronically, including notices posted on the Service or sent to your account email.

Injunctive relief. You agree that misuse of the Service may cause irreparable harm for which monetary damages may be inadequate, and we may seek injunctive relief without posting bond where permitted by law.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use of Hooeychat after changes become effective constitutes acceptance of the revised Terms.
